Arbetsgrupp utreder behov av att ändra bestämmelserna om konkurrensförbudsavtal
Arbetsminister Jari Lindström har tillsatt en arbetsgrupp på trepartsbasis för att utreda behoven av att ändra bestämmelserna om konkurrensförbudsavtal i lagstiftningen. Arbetsgruppen har till uppgift att bedöma hur tidsenliga bestämmelserna om konkurrensförbudsavtal är och bereda behövliga ändringsförslag.
Sätten att utföra arbete förändras ständigt och därmed har också betydelsen av kunskap ökat i betydande grad. Detta inverkar på företagens behov att skydda sina egna uppgifter. Å andra sidan är personalens möjligheter att utnyttja sin kompetens och att röra sig på arbetsmarknaden delvis motstridiga intressen, vilket bör tas i beaktande i bestämmelserna om konkurrensförbudsavtal.
Arbetsgruppens ordförande är äldre regeringssekreterare Seija Jalkanen vid arbets- och näringsministeriet. Medlemmar i arbetsgruppen är företrädare för de i sammanhanget viktigaste ministerierna och arbetsmarknadens centralorganisationer. Arbetsgruppens sekreterare är specialsakkunnig Johanna Ylitepsa vid arbets- och näringsministeriet.
Arbetsgruppens arbete baserar sig delvis på Jukka Ahtelas utredning om bestämmelserna om sekretessavtal och konkurrensförbudsavtal, som publicerades i juni. Utredningen visade att konkurrensförbudsavtal alltför ofta ingås utan något mer specifikt övervägande av om de verkligen behövs. Ett konkurrensförbudsavtal ingås trots att det ofta skulle räcka med ett sekretessavtal.
