Delningsekonomin skapar nya möjligheter men samtidigt utmaningar för myndigheterna och lagstiftningen
Delningsekonomin innebär nya möjligheter för konsumenter, företagare och företag. De nya innovativa verksamhetsmodellerna är dock en utmaning för den gällande lagstiftningen, konstaterar tjänstemannanätverket för delningsekonomi i en utredning som publicerades den 8 december 2017.
Delningsekonomins nya verksamhetsmodeller innebär en utmaning för lagstiftningen t.ex. när det gäller krav för tillträde till marknaden, beskattning, arbete och konsumentskydd. Det är inte alltid klart vilken lagstiftning de nya verksamhetsmodellerna omfattas av och vilka lagstadgade skyldigheter som gäller i olika situationer.
Debatten blir inte klarare av att det förekommer många olika begrepp. Mycket olika slags verksamhet kan nämligen anses höra till delningsekonomin. Nätverket påpekar också att trots att den typiska bilden av delningsekonomi är att den avser icke-vinstdrivande verksamhet baserad på samverkan, är en del av delningsekonomin trots allt affärsverksamhet.
Det finns en risk för att nyttan av delningsekonomin inte tas tillvara, om lagstiftningen är så otydlig att få vågar inleda ny slags verksamhet eller använda nya slags tjänster. Enligt tjänstemannautredningen bör man försöka styra utvecklingen av delningsekonomin på ett sådant sätt att alla parter känner till sina rättigheter och skyldigheter och delningsekonomin inte blir en inofficiell verksamhet som bedrivs i en gråzon.
Ny webbplats ska stödja delningsekonomin
– I enlighet med det som föreslås i utredningen ska arbets- och näringsministeriet skapa en för den offentliga förvaltningen gemensam webbplats där det finns information och olika myndigheters anvisningar om lagstiftning och olika lagstadgade skyldigheter som anknyter till delningsekonomi, säger kanslichef Jari Gustafsson från arbets- och näringsministeriet.
Avsikten är att webbplatsen ska vara till nytta för enskilda medborgare och företag men även för t.ex. kommunala myndigheter.
Delningsekonomin kastar ljus på förändrade arbetssätt och gör det smidigare att röra sig mellan företagande och lönearbete
Delningsekonomin är fortfarande ganska liten i Finland. Den kastar dock ljus på viktiga utvecklingsobjekt som på ett bredare plan hör samman med förändringar i samhället och t.ex. sätten att arbeta. I framtiden kommer arbete att utföras mer och mer under företagsliknande former eller som separata uppdrag, kanske vid sidan av ett traditionellt anställningsförhållande. Nätverket konstaterar att det vore viktigt att försöka ta fram konkreta metoder som gör det smidigare att röra sig mellan företagande och lönearbete, så att byråkratin inte blir ett hinder för att utnyttja olika arbetsmöjligheter. Det borde också göras så lätt och smidigt som möjligt att fullgöra olika lagstadgade skyldigheter.
– Om människorna i allt större utsträckning kan köpa och sälja tjänster via olika mobilapplikationer, vore det bra om vi i framtiden kunde sköta t.ex. skatteärenden på motsvarande sätt, säger kanslichef Gustafsson.
En del av delningsekonomins utmaningar är sådana att det krävs fortsatta utredningar för att man ska kunna lösa dem. Det behövs ytterligare utredningar om hurdana metoder som kan användas för att förebygga grå ekonomi, hur man ska lösa beskattningsmässiga utmaningar och hur delningsekonomin ska tas med i den officiella statistikföringen. Det vore också viktigt att göra en utvärdering av olika alternativ för att förtydliga gränsen mellan yrkesmässig och icke yrkesmässig inkvarteringsverksamhet.
